Pets During a Separation

Writer's picture: Lisa Browning Lisa Browning

Our furry friends are a part of the family so when a separation takes place there is always the tough question of who gets the pets?

In the state of New Jersey, there is a limited case law addressing which party keeps the pets after a divorce. Even though our pets are like our children the courts view and treat pets as personal property. Choosing which party gets the pets can be an extremely emotional and tough decision, therefore during the separation process issues regarding the pet’s custody, visitation, payment agreements, and other needs are discussed and resolutions are reached.

During the collaborative process, or in any out of Court settlement, I work with clients to cover all aspects of your life, and decisions are made to best fit you and your family including your furry family members. We can be as creative as we like when we are not involved in litigation.
